Terms & Conditions

Please read these Terms & Conditions carefully before using DayOS. By accessing or using the service you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using DayOS (the "Service"), you confirm that you are at least 16 years old and that you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use the Service.

These terms constitute a legally binding agreement between you and DayOS ("we", "us", or "our"). We may update these terms from time to time; continued use of the Service after notice of changes constitutes acceptance of the revised terms.

2. Description of Service

DayOS is a personal AI-powered diary application. The Service allows you to:

  • Record diary entries via text or voice transcription
  • Organise and review entries by date
  • Receive AI-generated summaries, insights, and reflections powered by AI language models (routed via OpenRouter)
  • Create and lock diary books — each diary fills with your entries over time and is automatically sealed when full
  • Search across your diary history

AI features involve sending the relevant portions of your diary content to OpenRouter, an AI routing service, which routes requests to AI language models (including both open-weight and proprietary models). For canvas board analysis, a rendered image of your board may also be processed. See our Privacy Policy for full details.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

3. User Accounts

You must create an account to use DayOS. You are responsible for:

  • Keeping your account credentials secure
  • All activity that occurs under your account
  • Notifying us immediately at info@dayosdiary.com if you suspect unauthorised access

You may not share your account with others or create multiple accounts to circumvent restrictions or billing. We may suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree to use DayOS only for lawful personal purposes. You must not:

  • Use the Service to store or transmit content that is illegal, defamatory, or infringes third-party rights
  • Attempt to gain unauthorised access to any part of our systems
  • Reverse-engineer, scrape, or copy the Service or its underlying software
  • Use the Service in a way that places an unreasonable burden on our infrastructure
  • Misuse AI features to generate harmful or deceptive content

We may remove content or suspend accounts that breach this section without prior notice.

5. Payment and Billing

DayOS uses a pay-per-page diary model. Specific charges apply as follows:

  • Free tier: A limited number of diary pages per month at no charge, as published on our pricing page.
  • Additional pages: Each page beyond the free allowance is charged at the rate displayed at the time of purchase.
  • Diary books: Additional page quota beyond the free tier is charged per diary book as listed in the app. A diary is automatically locked (sealed, read-only) when its page capacity is full.

All prices are displayed inclusive of applicable taxes where required. Payments are processed securely through our payment provider. We do not store your card details.

Charges are non-refundable except where required by applicable law or at our sole discretion. If you believe you have been charged in error, contact us within 14 days of the charge at info@dayosdiary.com.

6. Intellectual Property

Your content: You own all diary entries, notes, and other content you create in DayOS ("Your Content"). By using the Service you grant us a limited, non-exclusive licence to store, process, and transmit Your Content solely to provide the Service to you, including sending relevant content to AI providers to generate insights.

Our property: The DayOS name, logo, application code, design, and AI-generated summaries produced by the Service are owned by us or our licensors. You may not copy, redistribute, or create derivative works from them without our written permission.

We do not claim ownership of AI-generated text that is incorporated into your diary entries at your direction.

7. Data and Privacy

Your privacy matters to us. Our Privacy Policy explains what data we collect, how we use it, and your rights under applicable law including the UK GDPR and EU GDPR.

Key points:

  • Diary content is stored on Supabase (EU servers), encrypted with AES-256 at rest and TLS in transit
  • DayOS applies additional application-layer AES-256-GCM encryption to your diary entry text before storing it
  • AI features involve sending selected, decrypted content to OpenRouter (routing to AI language models including open-weight and proprietary models)
  • We do not sell your personal data to third parties
  • You may delete your account and all associated data at any time

8. Limitation of Liability

To the fullest extent permitted by law, DayOS and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data, loss of profits, or service interruptions.

Our total liability to you for any claim arising from these terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

The Service is provided "as is" and "as available". We make no warranty that it will be uninterrupted, error-free, or meet your specific requirements.

9. Changes to Terms

We may update these Terms & Conditions at any time. Where changes are material, we will notify you by email or by a prominent notice within the app at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new terms. If you do not agree to the revised terms, you should stop using the Service and may delete your account.

10. Marketing Communications

We may send you product updates or announcements. You may opt out at any time by emailing hello@dayosdiary.com with the subject "Unsubscribe" or by using the unsubscribe link in any marketing email. Transactional messages (sign-in codes, account or billing notices) are not affected by this opt-out.
